Legislative regulation

Order No. 997n was regulated by the issuance of SIZ by profession, typical issues of secretion of security secretions with their work under the influence of harmful and hazardous factors, high temperature and pollution.

Rules for flushing and neutralizing agents are established by order of the Ministry of Health and Social Development of December 17, 2010 No. 1122n. Signal clothing relies on the orders of the Ministry of Health and Social Development of the Russian Federation of 20.04.2006 No. 297.

  • the worker, in turn, must correctly apply protection issued to him;
  • with the impossible PM, the employee has the right to refuse to fulfill its work, which will not entail its attraction to disciplinary responsibility;
  • SIZ should correspond to their sex, sizes, nature and conditions of work performed;
  • the employer must organize accounting and monitoring the transfer of protection workers in the established periods;
  • terms of use are beginning to flow from the day the actual transfer of their employee and until the expiration date;
  • receipt is reflected in the record of the personal accounting card.

Industry rules

In the areas of economic activity, each section is governed by their individual regulatory legal acts, for example, the principles on which the means of protection in woodworking production are governed by the Decree of Minthouse No. 61 of 08.12.1997, and construction, construction and repair and construction work - by order Ministry of Health and Social Development No. 477 dated July 16, 2007. An electrician

Is the employer obliged to issue workwear?

Overalls and SIZ - the same thing?

Is there a fundamental difference between special clothing from PPE? According to a common definition, under the SIZ are referred to the means that are involved in order to prevent or reduce the impact on employees of enterprises of harmful production factors and pollutants. Specificity of legislation

Typical standards for issuing overalls are as a rule, in legal acts published by the executive authorities. For example, such provisions are in the order of the Ministry of Health and Social Development No. 541n of 01.10.2008. Ministry of Social Development can also issue other provisions regulating procedures for issuing employers free workwear to employees. For example, these may be orders regulating the corresponding activity in a particular sphere - housing and communal services, water management, construction, mining, metallurgy, oil and gas complex, etc.

The defining value in determining the obligations to issue PPE and workwear for the employer has not so much a profession as the actual conditions of production. For example, if we are talking about a chemical enterprise, in any case the norms of issuing workwear will be established for drivers, welders, locksters, craners - all those engaged in areas characterized by harmful surroundings or special temperatures. However, the laws may determine the specific types of PPE and overalls, which are optimized for use by specialists in specific positions. For example, the norms of issuing overalls for drivers in the food industry involve the equipment of employees with signal costumes, head removes, insulated vests and jackets, leather boots, as well as gloves that are covered with polymer. In turn, for workers who manage the means of transport in electric power industry, the corresponding norms may predetermine the need to issue a cloak to protect against water, boots, as well as special costumes.

It can be noted that the rules relating to the supply of workers in overalls are prerogative not only Russian legislation, but also other countries. Similar in many legal areas, legal acts operate, for example, in Belarus. The norms of issuing workwear in the Republic of Belarus, in general, are determined by the same principles as in the Russian Federation. Employees of Belarusian enterprises in those areas where harmful production is assumed should receive the necessary means of protection.

SIZ certification

The issuing rates of overalls imply that the corresponding PPEs issued by employees must be certified. In the 212nd article of the Labor Code of Russia, this is true. The certification in question should be carried out on the basis of the provisions, which are contained in the Resolution of the State Standard of the Russian Federation No. 34 of 19.06.2000, in which the relevant norms were approved and entered into force. Buying workwear and PPE, the employer must check whether in documents for the delivery of goods compliance marks and other information confirming the fact that the SIZ is certified.

A variant is possible that the employer complies with the provisions of the law reflecting the norms of issuing workwear, releasing SIZ on its own production. But in this case, certification is needed. How to spend it? To do this, contact the state body, which is accredited by the State Standard. In general, this will be one of the divisions of the All-Russian Research Institute for Certification. This institution has several test laboratories in which certification is carried out. The main criterion for the study of overalls and PPE produced by the employer is the compliance of GOST, which define various requirements for the quality of products. In the process of certification, overalls and PPE are defined as far as they comply with the requirements of GOST, as well as the category of common, as well as to the GOSTAs, regulating the specific type of PPE. Also in some cases, clothing can be examined for compliance with the other documents.

By purchasing overalls and other PPE in the right volume, the employer should also organize the quality test. For this, it is necessary to form a commission of 3 people or more. Issuing clothes in excess of standards

A variant is possible, in which the employer will wish to exceed the issuance of workwear established by law. It can be additional PPE, shoes and other products. This right is enshrined by companies in the provisions of the 221th article of the TK RF. It may take into account the position on this issue of the trade union. The employer can provide its employees with the types of PPE, which do not include the norms of issuing overalls in official legal acts. But at the same time, it may be necessary to conduct certification in the prescribed manner of workplaces of specialists. The main source of law in its conduct is the order of the Ministry of Health and Social Development No. 569 of August 31, 2007. The norms of issuing workwear and PPE, provided for in the laws, must be respected anyway. Only if the employer provided this compliance, he may think about issuing additional types of workwear to employees.

Also, the workflow, the need to manage which is predetermined by the issuance of workwear to employees, implies that the employer will form a register of the processions and posts for which PPE should be issued. This is usually a corporate document, which reflects the relevant information. It should register the order, in which the SIZ will be issued, used and stored. The structure of the document in question may look something like this: a list of professions and posts is created, and opposite each - the timing of the use of PPE and overalls, the number of copies of products that the employee must receive, as well as the frequency of their extradition.

The structure of the table, of course, can be completely different, this is an exemplary sample. Object rates of workwear must contain such criteria that provide for no less regular replacement during the year than is required in accordance with the provisions of the Ministry of Health and Social Development. But it is quite possible with an improvement in the standards provided by the law, if the financial position of the employer's company allows you to do this. Corporate norms of free issuing overalls, specialobuvi can be reflected in applications to a collective labor contract or as a separate act. If the employer establishes improved substantial and overalls issuing norms, then this information should be recorded in a collective agreement. Similarly, the employer must ensure the conditions for storing the SIZ so that overalls remain functional. While clothing is erased or is in a dry cleaning, the company must give the employee a spare kit. If he can't do this, then the specialist will not have the right to work in those conditions when the use of PPE is needed. Store overalls are necessary in special rooms. The employer's own resources can be useful when an employee must take PPC and workwear with an expired service life, but which can be revealed and cleaned, to re-use for the purpose of the preserved functional characteristics.

Terms of use must be explained

The employer is obliged to clarify to employees how to properly use PPE and overalls. It happens that inexperienced specialists are not entirely clear how one or another type of PPE operates, for example, a gas mask.

Therefore, the employer must conduct an appropriate briefing on the subject of correct use of PPE, as well as methods for checking their functionality and health. If necessary, the company must organize workouts, master classes and other events that contribute to the development of ways to use in one or another type of SIZ employees.

Overalls in combination and translation

If an employee combines profession or performs several works, then, not considering the SIZ and workwear issued to him and workwear, the employer is obliged to provide it with other types of PPE adapted to the peculiarities of the activities carried out. It is possible to navigate both on typical (sectoral) issuance norms of workwear and improved criteria adopted in the company.

If an employee is temporarily translated to another position, or if a person passes vocational training in the framework of relevant agreements, the SIZ and overalls are issued temporarily. The same rule applies to students involved in industrial practice.

The procedure for using PPE in singular temperature conditions

SIZ, which are intended for use by employees who fulfill their duties in a special temperature environment should be provided in the appropriate season. That is, under the "special conditions" in the ambient temperature aspect, the legislator understands the mainly cold or hot season. As soon as the season changed, the employee must give the appropriate SIZ or overalls of the company for storage until the next period should be needed to wear funds. Also, the periods of use of PPE for special temperature conditions are established by the company taking into account the position of the trade union and the specifics of the local climate. It can be noted that on the service life of PPE, intended for use in the cold or hot season, consists of periods when appropriate means are stored in stock.

Responsibility of employees

Employees of enterprises should relate to the workwear issued to them and PPE. If they lose the SIZ or spoil it, they will have to compensate for the corresponding costs. But if things become unsuitable or lost for reasons that do not depend on the employee, the employer should repair them for free or give new ones. Losing a person to work without PPE, as we noted above, it is impossible. Also unacceptable execution by an employee of labor functions, if SIZ is faulty or contaminated.

Employees are forbidden to go beyond the territory of the enterprise in PPE (if it does not require the specificity of the activity), as well as make the appropriate funds from the object at the end of the working day. But there are cases where the specifics of the work of work responsibilities of specialists are possible - for example, when carrying out geological intelligence, on logging, with a watched method of work, PPE and workwood remains at the staff and inoperative time.

Norms of issuing PPE is a list in which it is said which means and for what end-to-end professions and posts are obliged to issue employers. We understand which protective agents and in what quantity it is necessary to produce in the performance of certain works and which NPAs establish the rules.

What will we talk about

Ensuring safe conditions and safety of labor is the fundamental obligations of the employer, entrusted to him by labor legislation. At the request of Art. 212, 221 of the Labor Code of the Russian Federation, this includes the obligation to issue employees whose activities are related to the special conditions purchased at the expense of the organization's own funds, footwear, and other personal protective equipment. These include:

  • overalls, footwear and individual use tools to protect against harmful and dangerous factors, pollution;
  • special flushing and neutralizing substances.

They must be certified or to have a conformity declaration. They are issued in accordance with the standard standards (TN) approved by the Government of the Russian Federation.

The norms of issuing individual protection workers are approved by the Order of the Ministry of Labor of 09.12.2014 No. 997n. They regulate the allocation of funds to employees of 195 through professions working in harmful and dangerous working conditions, special temperature conditions, pollution related work.

Legislative regulation

Approved PPMs, reflected in regulatory acts, can be divided into 2 types: Norms of SIZ for general professions or general industry (they include the order of the Ministry of Labor of the Russian Federation of 09.12.2014 No. 997N; Order of the Ministry of Health and Social Development No. 1122 from 12/17/2010 and No. 297 dated 04/20/2006 etc.) and adapted to a separate sector of the economy (for example, the norms of issuing PPE in construction, transport, communications, chemical industries, metallurgy, etc.).

Order No. 997n was regulated by the issuance of SIZ by profession, typical issues of secretion of security secretions with their work under the influence of harmful and hazardous factors, high temperature and pollution.

Rules for flushing and neutralizing agents are established by order of the Ministry of Health and Social Development of December 17, 2010 No. 1122n. Signal clothing relies on the orders of the Ministry of Health and Social Development of the Russian Federation of 20.04.2006 No. 297.

The protection rules for general professions are regulated by the Order of the Ministry of Health and Social Development of the Russian Federation of 01.06.2009 No. 290n. There is also a procedure for the allocation, application and storage of protective equipment.

Typical sectoral issuance norms of the PPC were established by the Decree of the Ministry of Labor of the Russian Federation No. 66 of 25.12.1997. As an example, the Order of the Ministry of Health of the Ministry of Health of the Russian Federation can be brought from 03.10.2008 No. 543n, typical norms of issuing a SIZ employees of housing and communal services.

Cell-to-end professions and general issuing criteria

Through the professions that can be used in various economic sectors. For example, professions such as a joiner, a locksmith, janitor, cook and others. These specialists can work in different spheres of production. For them, order 997n establishes general criteria for transferring protective equipment:

  • all protection is purchased at the expense of the employer or are taken into temporary use under the lease agreement;
  • issued for free;
  • the employer is obliged to inform the workers about the PSE assimilated by him, familiarize with the rules corresponding to its specialty, TN;
  • the worker, in turn, must correctly apply protection issued to him;
  • with the impossible PM, the employee has the right to refuse to fulfill its work, which will not entail its attraction to disciplinary responsibility;
  • SIZ should correspond to their sex, sizes, nature and conditions of work performed;
  • the employer must organize accounting and monitoring the transfer of protection workers in the established periods;
  • terms of use are beginning to flow from the day the actual transfer of their employee and until the expiration date;
  • receipt is reflected in the record of the personal accounting card.

Industry rules

In the areas of economic activity, each section is governed by their individual regulatory legal acts, for example, the principles on which the means of protection in woodworking production are governed by the Decree of Minthouse No. 61 of 08.12.1997, and construction, construction and repair and construction work - by order Ministry of Health and Social Development No. 477 dated July 16, 2007. In addition, the legislation allowed the publication by the employer of its own regulatory acts regulating the issuance of PPE in the enterprise, provided that these standards will improve the position of the employee.

An employer must be used by industry principles on a specific activity. And the standard sectoral norms of issuing personal protective equipment for general industries use only if there are no rules in the first to meet the work performed by the work. This indicates the explanation of the Ministry of Internal Affairs of the Russian Federation (Letter No. 15-2 / OOG-1049 dated 03/16/2016).

For example, from the current labor standards, the deposit of catering establishments is governed by typical sectoral issues of free issuance of workwear, specialobuvi, etc. Trade workers approved by the Decree of the Ministry of Labor of the Russian Federation dated December 29, 1997 No. 68.

The list of professions, which are supposed to have overalls, small: manufacturer of food semi-finished products, a kitchen worker, a dishwasher washer, a worker performing work on the carpet washing, but this does not mean that overalls are allocated only to these professions.

The names of the professions are indicated in accordance with the ETKS, for example, according to the approval of the Decree of the Ministry of Internal Affairs of the Russian Federation of 05.03.2004 No. 30, professions related to trade and theacy, are listed in the section "Trade and Public Food" and in it are included Professions: Buffetr, Kitchen Worker, Personnel holder, etc.

The public catering can and should be guided not only by the Model Stands No. 68, but also standards for issuing trade protection items. For example, ensure the norms of the PC is a buffetcher, an administrator in the dining room.
