Part-time cleaner and nurse. Transferred from nurse to cleaner with the same responsibilities and lower salary

Job search 19.08.2020

For most people there is no difference, but for employees of medical institutions, the job title alone determines labor responsibilities, wage and vacation. The reorganization of institutions led to the fact that hospital staff were divided into medical and technical ones, which led to staff reductions, confusion over responsibilities and the transfer of employees to other positions. To understand the responsibilities of employees of a medical institution, you first need to understand who is a medical worker and who belongs to other personnel? Federal Law "On the fundamentals of protecting the health of citizens in Russian Federation" gives us the definition of a medical worker: medical worker - individual who has a medical or other education, works in a medical organization and whose labor (official) responsibilities include the implementation of medical activities, or an individual who is individual entrepreneur directly involved in medical activities; The law also defines medical activities: medical activities - professional activity to provide medical care, conducting medical examinations, medical examinations And medical examinations, sanitary and anti-epidemic (preventive) measures and professional activities related to organ and (or) tissue transplantation, circulation of donor blood and (or) its components for medical purposes; Whether these actions relate to the work of a cleaner or a nurse can be clarified from the documents: Order of the Ministry of Health dated July 23, 2010 No. 541n and Resolution of the Ministry of Labor dated November 10, 1992 N 31 (supplements Order of the Ministry of Health and Social Development of the Russian Federation dated October 24, 2005 N 648), from which it becomes It’s clear: The nurse is a health worker, the cleaning lady is not. This follows from the responsibilities listed in the documents. Both the nurse and the cleaner are required to clean the premises, but the nurse cleans the premises of a medical organization, while the cleaner does the cleaning in production or office premises. Next come lines about the nature of the work, accurately conveying the place of activity - for a nurse: Helps the head nurse in obtaining medications, instruments, equipment and delivering them to the department. Receives from the sister-housewife and ensures proper storage and use of linen, household equipment, dishes and detergents... for the cleaner: Removing dust, sweeping and washing manually or with the help of machines and devices of floors, stairs, stairwells, windows, walls, ceilings in industrial premises... Moreover, the cleaner is not engaged in carrying out sanitary and anti-epidemic measures, but only performs sanitary treatment of industrial premises, therefore the powers of such an employee are outside of medical activities. Can a cleaner work in a medical facility? To implement such activities, you need to keep in mind the qualification characteristics of workers by industry, for example, a cleaner production premises, can work in factories or workshops, that is, in places of continuous industrial work. SanPiN 2.2.4.548-96. 2.2.4 tells us which premises should be considered production: Production premises are enclosed spaces in specially designed buildings and structures in which work is carried out constantly (in shifts) or periodically (during the working day). work activity of people. The definition is vague and does not provide a specific description, so let us turn to the definition from the Russian encyclopedia on labor protection: Industrial premises are enclosed spaces (rooms, halls, buildings) in which work is carried out constantly (in shifts) or periodically (during the working day). production activity. According to their purpose, they are divided into production facilities (main workshops), auxiliary production facilities (for auxiliary production), energy facilities (supply of compressed air, steam, electricity), and storage facilities. Information about the availability of such premises should be checked with the administration of a particular medical institution, but such premises probably are not: halls, corridors, lobbies. A cleaner will be available to clean the above mentioned areas. office premises, her responsibilities include cleaning the halls, lobbies, staircases, service and other premises of public and administrative buildings. Therefore, such an employee can engage in work activities on the territory of the institution, but only in strictly designated places. And in the wards? Patient rooms are neither industrial nor service premises. Work in wards and departments involves the implementation of sanitary and epidemiological measures, and since the responsibilities of any of the mentioned cleaners include only maintaining hygiene and sanitary treatment in the conditions of industrial premises and equipment being serviced, only nurses have the right to work in the wards.

Transferring nurses to cleaners is a way to optimize personnel in a medical institution. However, when transferring a nurse to the position of a cleaner, she labor function will undergo serious changes.

Is it legal to replace nurses with sanitary cleaners? Read the answer in the Chief Physician System.

Consequently, when a nurse is transferred to the position of a cleaner, her job function will undergo serious changes. It is for this reason that it is necessary to obtain the employee’s written consent to the transfer.

The feasibility of transferring an employee from the position of orderly to the position of cleaner

The Russian government plans to increase average wages by 2018 social workers medical institutions, junior and paramedical or pharmaceutical personnel up to 100 percent of the average salary in a particular region.

This means that the salaries of mid-level and junior medical staff will be approximately equal, and to be more precise, the salaries of junior medical workers will increase. This, in turn, will make it possible to staff the full-time positions of nurses.

However, this will one way or another lead to the fact that at some certain period of time the salaries of middle and junior medical personnel will be equal.

However, there is a problem, and, oddly enough, it sounds very banal for our state - health care facilities simply do not have the money for such an increase in salaries.

This explains the desire of managers of medical organizations to save on junior medical personnel.

In reality, there are two options for reducing labor costs for junior medical staff:

  • outsourcing – concluding an agreement with an external contractor;
  • transfer of nurses to cleaners.

In reality, outsourcing, as a rule, does not pay for itself, so the administration of health care facilities prefers to focus on the first option.

Usually, medical institutions they are trying to save on positions included in the ZP-health form (Rosstat order No. 581 of October 7, 2016). That is why transfer to a non-medical position primarily concerns nurses.

What will change during translation?

Requirements for translation execution: everything according to the law

The Ministry of Labor has established the following professions of a cleaner:

  • office cleaner;
  • industrial cleaner.

Therefore, when transferring a nurse to the position of a cleaner, you need to choose one of the above titles. However, it is worth remembering that currently there is no position “cleaner of office and industrial premises”.

It is necessary to clearly explain to the employee why she needs to transfer to another position. This is very important because without her written consent the translation will be a violation (Articles 72, 72.1 Labor Code RF).

When making a transfer, it is necessary to conclude an additional agreement with the employee to the employment contract, which specifies all the conditions that are to be changed:

  1. New job title.
  2. Responsibilities of the employee.
  3. New terms of remuneration.

An additional agreement signed by both parties is a mandatory component of the employment contract. It is this that confirms that the employee agrees to move to another position.

You can use another method, which is also within the framework of the law - termination of the employment contract in the event of a reduction in the staff or number of personnel of a health care facility.

In other words, it is permissible to dismiss an employee if, even taking into account his written consent, there is no possibility of transferring him to another position.

This applies to both vacant positions and positions that correspond to the employee’s qualifications, as well as vacant lower positions or lower paid work that the employee can perform taking into account his state of health.

The employee must be offered all positions available in the local area. In addition, the employer is obliged to offer vacancies in other locations if this is stipulated in the collective labor agreement or employment contract.

On this basis, it is possible to introduce new positions - a cleaner of industrial premises or a cleaner of office premises, and reduce the positions of nurses.

At the same time, nurses should be offered positions as cleaners. It is worth keeping in mind that if the positions of nurses are reduced, they can be offered positions not only as cleaners, but also as janitors, etc.

Another reason for the dismissal of a nurse is certification for compliance with the position held in accordance with the professional standard “Junior Medical Personnel”, which requires employees to have a secondary general education and vocational training by the position of "Orphan".

However, this professional standard was introduced recently, therefore, not a single nurse meets these requirements.

This means that, based on the results of the certification, a nurse can be fired due to inadequacy for the position held due to insufficient qualifications, and she can be offered the position of a cleaner.

There is another way to transfer nurses to cleaners - economically. A cleaner's salary is set higher, and the nurse is simply lured to this position. Further, the cleaner’s salary may not be indexed at such a rapid pace.

However, in this case, it becomes problematic to demand that the nurse perform the previous work in full. The whole problem is that not all the duties of a nurse can be entrusted to a cleaner.

Nevertheless, labor legislation does not interfere with the approach of the job responsibilities of a cleaner of industrial premises to the job responsibilities of an orderly. IN employment contract additional provisions are included that do not worsen the employee’s position.
