Question: Is it possible to enter staffing table position "delivery driver"? If this is not possible, but there is such a position in the staffing table, then how to correctly remove it from the staffing table and make the correct entry in work book?

Answer: In accordance with Article 19 of the Labor Code of the Republic of Belarus, the names of professions, positions, specialties must correspond to the qualification reference books approved in in the prescribed manner.
General provisions of the Unified Tariff and Qualification Directory of Work and Professions of Workers, approved by the Resolution of the Ministry of Labor and social protection of the Republic of Belarus dated March 30, 2004 N 34, it is established that the name of a worker’s profession must be established in strict accordance with the ETKS of the Republic of Belarus, taking into account the actual work performed in a particular production.
Issue 52 of the ETKS RB contains the qualification characteristics of the worker's profession "car driver".
The position "forwarder" is contained in issue 1 of the Unified Qualification Directory of Positions for Employees of the Republic of Belarus (USSD RB) and belongs to the category of employees.
The profession "driver-forwarder" is not provided for in the editions of the ETKS RB.
Taking into account the specified order of naming the professions of workers, and also the fact that the position of “forwarder” is not a worker’s profession, There is no reason to introduce the profession (position) “driver-forwarder” into the organization’s staffing table. The staffing table should indicate the profession "car driver" indicating the multiple size tariff rate first category in relation to technical specifications serviced vehicle.
If the driver of the car performs the duties of freight forwarding, then in this case the staffing unit (its share) of the position “freight forwarder” should be introduced into the employer’s staffing table with the establishment of the appropriate wage fund based on the volume of work performed for this position and installed for the driver of the car in accordance with the provisions of Article 67 of the Labor Code of the Republic of Belarus, an appropriate additional payment, the amount of which is established by the employer by agreement with the employee.
The entry “driver-forwarder” in the staffing table must be brought into line with the qualification reference books, taking into account the function performed by the employee. of this order(orders) a corresponding change is made to the entries in the work book.

Job responsibilities. Organizes the delivery of goods with a guarantee of safety on the terms and conditions stipulated by the contract transport expedition, contract for the carriage of goods and other contractual obligations with the cargo owner. Coordinates the interaction of all participants in cargo delivery. Compiles technological and economic justification transport and technological routes and cargo delivery schemes, taking into account the wishes and requirements of cargo owners. Organizes the provision of services for the acceptance of goods (cargo), their transportation and delivery in the prescribed manner. 1. Forwarding driver as an independent qualification is not provided for by the current regulatory documents. You have a qualification as a car driver, confirmed by:

a) the current qualification directory of workers’ professions, which sets monthly salaries” (approved by the Decree of the State Committee for Labor of the USSR, All-Union Central Council of Trade Unions dated February 20, 1984 no. 58/3-102);

b) Resolution of the Ministry of Labor of the Russian Federation dated November 10, 1992 N 31 (as amended on November 24, 2008) “On approval of tariff and qualification characteristics for general industry occupations of workers”;

c) order of the Ministry of Transport of the Russian Federation dated September 28, 2015 N 287 “On approval of professional and qualification requirements to employees of legal entities and individual entrepreneurs carrying out transportation by car and urban ground electric transport."

2. Hiring carried out in the form of wording in the order and subsequent entry in the work book with the following content: “hired as a driver of a car of 3, 2, 1 classes, or a driver of a car of 4, 5, 6 categories.”

Car driver must carry out his activities with the employer on the basis of an employment contract and job description.

3. According to the above documents, It is the driver's responsibility to safely and professional management a vehicle of the corresponding category in various conditions traffic, supplying vehicles for loading and unloading cargo, monitoring the correct loading, placement and securing of cargo in the back of the car, etc. But there is no obligation to accept, accompany and hand over the cargo, issue waybills and other transportation documents.

4. If the employer builds its activities by involving car drivers in freight forwarding duties(acceptance of cargo, its safety along the route and delivery of cargo to the consignee, registration of waybills and various acts), then the position of forwarder driver appears.

4.1. Driver forwarder – this is a job as a car driver with the combination of the profession of a freight forwarder. Combination of professions is provided Labor Code RF Article 60.2. Combining the profession of a car driver with the position of a freight forwarder occurs with the consent of the driver and for an additional payment. A driver who combines the duties of a freight forwarder can simultaneously combine the duties of a loader, also with his consent and with an additional payment.

4.2. With driver, forwarder, employer labor Relations draws up two agreements:

4.2.1. Employment contract with the car driver.

4.2.2. Agreement on financial liability the driver of the car for forwarding the transported cargo and other material assets. The basis for concluding an agreement on financial liability is Resolution of the Ministry of Labor of the Russian Federation dated December 31, 2002 No. 85.

4.3. In practice, one can be concluded employment contract with the driver of the car with the entry into it of entries regulating the driver’s obligation to perform forwarding functions.

4.6. The standard form of an agreement on full collective (team) financial liability is given in Appendix No. 4 to the above-mentioned resolution of the Ministry of Labor of the Russian Federation (applied when labor activity cash-in-transit drivers).

5. Forwarding driver when accompanying cargo or other material assets (hereinafter referred to as “cargo”), he accepts the cargo according to the bill of lading, delivers the cargo again according to the bill of lading, ensures the safety of the cargo along the route and delivers documents for the cargo.

5.1. Before the freight forwarder driver accepts the cargo, the shipper forms the piece cargo to be sent in the form of packages. Piece cargo can be packaged or bulk, and is taken into account when sending cargo by the number of pieces and weight.

The forwarder driver controls the placement of cargo at the loading point. vehicle in order to ensure uniform distribution of cargo mass over the entire area of ​​the vehicle or container body. 5.2. If the cargo in covered vehicles and containers is intended for one consignee, then the consignor carries out sealing. Seals are attached (clause 59 of the Rules for the carriage of goods):

a) for vans or their sections - one seal on the doors;

b) containers have one seal on the doors;

c) for tanks - there is one seal on the hatch cover and the drain hole.

For cargo in a container, if it is removed from the vehicle, the freight forwarder driver, the shipper, issues an accompanying statement for delivery to the consignee. The forwarding driver signs for receipt of the container. The form of the accompanying statement is in Appendix No. 8 of the Rules for the Transportation of Goods.

6. Ensuring the safety of cargo along the route.

6.1. The forwarder driver can perform his functions in two directions.

First, he performs forwarding functions on the instructions of the Carrier ( legal entity or individual entrepreneur). In this case, the Carrier is responsible for the safety of the cargo. And as an option, the Carrier can send a guard with the cargo, or can entrust the forwarder driver with ensuring the safety of the cargo. It all depends on the nature of the cargo, the distance of transportation, one or two drivers per trip.

Second. If the forwarder driver is legally independent (individual entrepreneur) and he enters into a contract for the carriage of goods from own name, then responsibility for the cargo falls on him.

6.2. Rules of conduct for the forwarder driver during cargo delivery (en route). The vehicle body with cargo must be protected from entry by third parties. When driving, close the passenger door from the inside. Do not take passengers. For recreation, stop at paid parking lots (keep receipts). When parking, if possible, park the car in such a way as to limit access to the cargo as much as possible (with the back door against the wall, etc.). Do not leave cargo and vehicle documents unattended. If, at the insistence of traffic police officers, a vehicle and cargo are inspected, then this operation is carried out in the presence of the forwarder driver and two witnesses with the drawing up of a protocol.

7. Forwarding driver Upon arrival at the consignee, he hands over the cargo with the presentation of two copies of the waybill. The consignee signs for the delivered cargo, the forwarding driver signs for the delivery of the cargo. One copy of the executed waybill remains with the consignee, the second copy of the issued waybill remains with the forwarder driver.

8. Forwarding driver in case of violation of the terms of the contract for the carriage of goods (lack of cargo, delay in loading, improper stowage of cargo on the vehicle, causing an unscheduled stop, etc.) makes an appropriate entry in section 17 of the consignment note.
