Hi all! As things progressed, I decided to expand as much as possible on the topic of medical kits for providing first aid to employees. In this note, I will answer the questions: is it necessary to create an order appointing a person responsible for the acquisition, storage of medical kits and replenishing them with medications, whether he needs to be trained, and what medications and drugs should be included in the medical kit. In addition, I will conduct a kind of educational program on this topic. A BONUS to everything will be samples and examples of orders, etc.

In order to expand on the topic of medical first aid kits, you should start with the basics - this Labor Code of the Russian Federation and its 10th section " OCCUPATIONAL SAFETY AND HEALTH «.

Article 223 of the Labor Code of the Russian Federation - Sanitary, medical and preventive services for workers

Providing sanitary, medical and preventive services for workers in accordance with labor protection requirements is the responsibility of the employer. For these purposes, the employer, in accordance with established standards, equips sanitary premises, premises for eating, premises for providing medical care, rooms for rest during working hours and psychological relief; are being created sanitary posts with first aid kits stocked with a set of medicines and first aid preparations; apparatus (devices) are installed to provide workers in hot shops and areas with carbonated salt water, and more.

Transportation to medical organizations or to the place of residence of employees affected by industrial accidents and occupational diseases, as well as for other medical reasons, is carried out using the employer’s vehicles or at his expense.

Number of first aid kits in production May be determined by a local act of the employer, taking into account the number of employees and the nature of the work.

In this regard, the employer issues an order appointing an employee responsible for the acquisition, storage, and use of a first aid kit, approves the contents of the first aid kit (in the event that the composition of the first aid kit for employees according to Order No. 169n does not objectively meet the requirements of the enterprise), designates the storage location of the first aid kit, and adopts the procedure for using and monitoring the contents of the first aid kit. Wherein the employer, in accordance with Article 212 of the Labor Code of the Russian Federation, is obliged to train the employee appointed responsible for the storage and use of the first aid kit in providing first aid to those injured at work. In addition, the organization starts first aid kit log, and also developed and approved instructions for first aid.

Taking into account the above, we believe that there is no need to introduce an additional position into the organization’s staff on the above issue.

So, the picture of medical kits becomes more or less clear and understandable. At least someone has given some clarification on this issue, but it is worth understanding that this letter is a recommendation and not a mandatory requirement, because the letter contains “maybe..” the employer can determine all of the above by a local act (order).

Again there is Art. 223 of the Labor Code of the Russian Federation and the issue of first aid kits in any case must be worked out so that no one has any complaints or problems.

Everything is clear about the composition of medical kits; they must be equipped in accordance with Order No. 169n of March 5, 2011 “On approval of the requirements for equipping first aid kits with medical products to provide first aid to employees”.

There is a dubious point in the letter that if the composition of the medical kit according to Order No. 169n does not objectively meet the company’s requirements, then the employer approves its composition. What composition?! What is acceptable to use above 169n?! Unclear…

If anyone doesn’t know, then due to such misunderstandings, something like the following situation can happen (based on real events):

One day, the shop manager saw his sick employee and decided to give him cold medicine (such as Theraflu or the like) from the first aid kit, the employee turned out to have a heart disease and he felt ill, resulting in death. In the end, a criminal case was opened against the workshop manager for not having the right to “treat.” In other words, the provision of medical care by a person who does not have the right to it.

A common situation is when first aid kits are full of various drugs and preparations that go far beyond the list of Order No. 169n. And what’s not there: noshpa, Theraflu, validol, etc. and so on.

This happens because some individuals, without delving into the issue, want to treat their frequent health problems at the expense of the employer, or simply think that by purchasing such medicines and preparations, they are acting for the benefit of the entire team... but... they are mistaken.

Another reason is that this whole issue has not been worked out, and therefore remains on its own.

The recommendations from the letter from the Federal Service for Labor and Employment are quite competent, why not use them?! All that is required is create an order- who, what, where, when, how and organize related events.

For this we will need the following samples, examples and forms (choose to your taste and color):

One thing that follows from the above letter and order No. 477 is that the person providing first aid must have appropriate training and/or skill.

How can this person get such training?! Apparently only in a specialized training center, where, after completing the training, he will receive the appropriate document and the right to provide first aid to victims, as well as train employees in first aid.

Because Internal training in first aid is not regulated; it should be carried out, at a minimum, in compliance with GOST 12.0.004-90 “System of occupational safety standards. Organization of occupational safety training. General provisions" (the document has lost force - see information), i.e. create a commission of three persons trained to provide first aid in a specialized training center, conduct (conduct) training according to the recommendations specified in Letter No. 14-8/10/2-1759 dated February 29, 2012 and Order of the Ministry of Health and Social Development of Russia dated May 4, 2012 . No. 477, formalize this whole matter with the appropriate protocol from the above GOST. If you also use special simulators (Gosha, Maxim, etc.) during training, then there will be no price for such an event.

This is what I gave, perhaps the most ideal option.

The less ideal and most common option looks exactly the same, only the commission consists of people who have passed occupational safety training at the training center and having the appropriate certificates. It seems like there is a section on providing first aid to victims in a 40-hour training program on occupational safety for managers and specialists - and that’s enough.

Is it possible to identify such training with special training and/or first aid skills? I personally think not.

It all depends on what situation the employer can and is ready to get into.

There is another interesting point - from the existing legal regulations, there are two opinions about whether the employer is obliged to provide first aid.

1. First opinion

The employer is obliged to immediately provide first aid to someone injured in an accident (paragraph 2 of Article 228 of the Labor Code of the Russian Federation - Responsibilities of the employer in the event of an accident):

In case of accidents specified in Article 227 of this Code, the employer (his representative) is obliged to:
- immediately organize first aid for the victim and, if necessary, transport him to a medical organization;

For these purposes, each organization must have a first aid kit (Part 1 of Article 223 of the Labor Code of the Russian Federation), the contents of which are determined by Order of the Ministry of Health and Social Development of Russia dated March 5, 2011 No. 169n.

If an employee has clearly suffered serious injuries and requires urgent medical intervention (Part 1, Article 35 of Federal Law No. 323-FZ of November 21, 2011), it is recommended to call an ambulance.

Important! The employer is obliged to transport the victim to the hospital using his own transport or at his own expense (Part 2 of Article 223 of the Labor Code of the Russian Federation).

TOTAL: the employer is obliged.

In accordance with Part 4 of Article 31 of the Federal Law of November 21, 2011 No. 323-FZ, vehicle drivers and other persons have the right to provide first aid if they have appropriate training and (or) skills.

1. Lack of consciousness.

2. Stopping breathing and blood circulation.

3. External bleeding.

4. Foreign bodies of the upper respiratory tract.

5. Injuries to various areas of the body.

6. Burns, effects of exposure to high temperatures, thermal radiation.

7. Frostbite and other effects of exposure to low temperatures.

8. Poisoning.

TOTAL: the employer is not obliged.

Considering the strength of the documents, the Labor Code of the Russian Federation has priority here. One way or another, the legislator definitely does not have the truth in this matter.

What conclusion can be drawn from all of the above?

1. First aid training It’s possible in any way (except for specialized training at a training center), but if an accident occurs at work, then only a properly trained employee who has the appropriate document has the right to provide first aid to the victim(s). Otherwise, no matter how trained or without the appropriate documents, he may become extreme and fall under an article of the Criminal Code. If an accident occurs at work, in which it would be possible to save the victim’s life, but this does not happen due to the lack of officially and unofficially trained persons, then the employer himself becomes the last resort.

2. The medical kit must be and must be equipped in accordance with the order of the Ministry of Health and Social Development of Russia dated March 5, 2011 No. 169n. If other medicines and preparations are additionally stored and used in it, this may turn into an unpleasant story for the one who dispensed the wrong pill from this medicine cabinet. Everything else that was set out in the Letter of the Federal Service for Labor and Employment dated November 7, 2012 No. PG/8351-3-5 is advisory in nature.

3. It's up to you to draw conclusions.

Medical first aid kits at the enterprise: what do you need to know?

To avoid problems with first aid kits, it is advisable to establish a systematic procedure and rules for checking them in a local act, since these issues are not regulated by law. The purchase of medications and timely replenishment of first aid kits can be entrusted to honey. an employee or a specialist who has undergone special training. If there are none, then the one who is most suitable for this, in the opinion of management, is selected. It is worth noting that the employee must give his consent; without this, he cannot be appointed.

According to industry regulations, the following may be responsible for first aid kits:

  • Head of the department.
  • Head of a department or section.

If the regulations of the area in which the company operates do not regulate this issue, then the best performer of the role of the person responsible for first aid kits will be an occupational safety specialist. He will not only buy new products to replace used ones, but also ensure the timely replacement of expired products or damaged packaging.

Special attention should be paid to the storage location of the first aid kit. Many people prefer to store first aid kits in the office of the person in charge, but this is wrong, since he is not always on site.

According to the twenty-third paragraph of the Labor Safety Rules for printing organizations POT RO 29-001-2002, the forty-eighth paragraph of the Industry Rules for labor protection when working with special liquids in civil aviation, paragraph 2.1.7 of the Labor Safety Rules when working on radio relay communication lines POT RO-45-010-2002 and many others, the first aid kit should be stored in an easily accessible place. If industry regulations do not specify a specific storage location, then the general rule must be followed.

According to Order No. 169n, at a minimum, a company must have one first aid kit. But with large enterprises the situation is different; first of all, they need to focus on the instructions in industry regulations. If there are no instructions in the latter, then the required amount is determined together with honey. employee or occupational safety specialist.


A unified form of this order does not exist, so it is free-form. The order for completing first aid kits must contain information about who is appointed responsible for the first aid kit, where first aid kits should be stored and how many pieces there should be. In addition, the procedure for using and monitoring the contents of first aid kits is described.

In addition to issuing an order, you need to keep a log of the use of first aid kits, create and approve instructions for providing first aid.

What happens if there is no first aid kit?

If the employer ignored the requirements of the order “On approval of the requirements for the composition of first aid kits,” then this fact will be qualified as a violation of the labor protection law.

In this case, officials face a fine of one to five thousand rubles, and legal entities - from thirty to fifty thousand rubles, or termination of activities for a period of up to ninety days.
